Terms of Service

By downloading, installing, or using the ProteinLog app, Apple Watch companion app, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

We reserve the right to update these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

ProteinLog is an AI-powered nutrition tracking application that allows users to log meals via photo, voice, text, barcode scan, or manual entry, and monitor their daily nutritional intake. The Service includes:

• AI-powered food photo and text analysis for nutrition estimation.
• Barcode scanning with lookups from third-party food databases (FatSecret, USDA, Open Food Facts).
• Daily macro and nutrition goal tracking.
• Optional integration with Apple Health (HealthKit) to write nutrition data.
• An Apple Watch companion app for viewing and logging meals.
• Saved meal templates for quick re-logging.
• Push notifications for analysis completion.

All nutrition estimates provided by the Service — whether from AI analysis, barcode lookups, food search results, or recipe data — are for informational purposes only and may not be accurate. They are not a substitute for professional dietary or medical advice.

You must be at least 13 years of age to use the Service. By using ProteinLog, you represent and warrant that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

You may sign in using Apple, Google, or email. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete registration information.
• Notify us immediately of any unauthorized use of your account.
• Not share your account with or transfer it to any other person.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Upload content that is unlawful, harmful, offensive, or infringes on any third-party rights.
• Submit images or text that are unrelated to food or nutrition for the purpose of abusing the AI analysis system.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Reverse-engineer, decompile, or disassemble any portion of the Service.
• Use the Service for any commercial purpose without our prior written consent.
• Interfere with or disrupt the integrity or performance of the Service.
• Circumvent subscription requirements or abuse free trial offers.

Nutrition estimates in ProteinLog are generated using third-party artificial intelligence models (via OpenRouter) and supplemented by data from public and licensed nutrition databases including FatSecret, USDA FoodData Central, and Open Food Facts.

These estimates may be inaccurate, incomplete, or inconsistent. Factors such as food preparation methods, portion sizes, regional variations, and image quality can significantly affect accuracy. You should not rely solely on ProteinLog for dietary decisions, especially if you have allergies, medical conditions, or specific nutritional requirements.

ProteinLog is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition. Always consult a qualified healthcare professional before making significant changes to your diet.

ProteinLog offers optional integration with Apple Health to write nutrition data (calories, protein, carbohydrates, and fat) from your logged meals. This feature requires your explicit permission and can be enabled or disabled at any time.

HealthKit data is governed by Apple's terms and remains on your device and within Apple's ecosystem. We do not access, read, store, or transmit your HealthKit data to our servers. HealthKit data is never used for advertising or shared with third parties.

You retain ownership of the content you submit (e.g., food photos, meal descriptions, and voice transcriptions). By submitting content, you grant ProteinLog a limited, worldwide, non-exclusive, royalty-free license to use, process, store, and display that content solely for the purpose of operating and improving the Service.

Food photos you submit are stored on our cloud infrastructure and may be sent to third-party AI providers for analysis. By submitting photos, you confirm that you have the right to share them and that they do not contain sensitive personal information beyond food imagery.

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, and software — are the exclusive property of Swiftful Dynamics and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your data.

Certain features of the Service require a paid subscription. By subscribing, you agree to pay all applicable fees. Subscriptions are processed and managed through the Apple App Store and are subject to Apple's terms and conditions.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription in your Apple ID account settings.
• Refunds are handled by Apple in accordance with their App Store refund policies.

We use RevenueCat to manage subscription entitlements. Your subscription status and anonymous transaction data are shared with RevenueCat for this purpose.

The Service integrates with third-party services including AI model providers, food databases, authentication services, cloud infrastructure, and payment processors. These services are governed by their own terms and privacy policies. We are not responsible for the practices of third-party services, though we select providers that maintain appropriate data protection standards.

We may suspend or terminate your access to the Service at any time, with or without cause or notice, at our sole discretion — including for violation of these Terms. You may also delete your account at any time by contacting us.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive will survive, including intellectual property provisions, disclaimers, indemnification, and limitations of liability.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY NUTRITION DATA, AI-GENERATED ESTIMATES, OR THIRD-PARTY DATABASE RESULTS PROVIDED THROUGH THE SERVICE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PROTEINLOG AND SWIFTFUL DYNAMICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, REVENUE, OR HEALTH OUTCOMES — ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, WE ARE NOT LIABLE FOR ANY HARM RESULTING FROM RELIANCE ON NUTRITION ESTIMATES, AI ANALYSIS RESULTS, OR FOOD DATABASE INFORMATION PROVIDED THROUGH THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) $10 USD.

You agree to indemnify and hold harmless ProteinLog, Swiftful Dynamics, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.
